Terms of Service

Terms of Service

MMM Underground LLC | Triple M Underground

Welcome to Triple M Underground, operated by MMM Underground LLC (“Triple M Underground,” “MMM Underground,” “we,” “us,” or “our”), based in Blaine, Minnesota.

These Terms of Service provide general information about using our website, requesting services, and our standard business practices.

Important: These website terms do not replace an accepted estimate, signed proposal, work authorization, or service contract. The scope, pricing, payment schedule, warranties, and other conditions for a particular job are established by the applicable agreement and Minnesota law. Where a project-specific agreement conflicts with these general terms, the project-specific agreement controls to the extent permitted by law.

1. Services Provided

Triple M Underground provides underground utility, sewer, waterline, drain cleaning, inspection, and excavation services.

Our services may include:

  • Emergency drain and sewer services

  • Drain cleaning and hydro jetting

  • Sewer camera inspections and locating

  • Frozen sewer and water service assistance

  • Sewer and water service line repairs and replacements

  • Underground utility installation and repair

  • Excavation and trenching

  • Site grading and dirt work

  • Backfilling and property restoration

Not all services are available in every location or situation. Work is subject to applicable licensing, bonding, registration, permitting, and inspection requirements. When appropriate, services may involve properly qualified subcontractors or specialty providers.

2. Service Requests and Scheduling

Submitting an online form, calling, texting, or requesting an estimate does not create a confirmed appointment or authorize work.

Appointments and services are subject to confirmation by Triple M Underground.

Arrival times and project schedules are estimates and may change due to emergency calls, traffic, weather, ground conditions, utility locating, equipment availability, inspections, or other factors beyond our reasonable control.

We will make reasonable efforts to notify customers of material scheduling changes.

3. Estimates and Pricing

Estimates and proposals are prepared using information reasonably available at the time, including customer-provided details, visible site conditions, available utility information, and any inspections performed.

Underground conditions cannot always be determined before excavation or repair work begins.

Unexpected conditions may include rock, groundwater, buried debris, unsuitable soil, unstable trench conditions, underground obstructions, additional pipe damage, or incorrectly located utilities.

If conditions require work beyond the authorized scope, we will explain the issue and request approval for additional work and pricing before proceeding, except as otherwise permitted by the project agreement or applicable law in an emergency.

Additional work may require a revised estimate or written change order.

Only work authorized under the applicable agreement will be billed, subject to lawful charges for approved changes and costs.

4. Emergency and After-Hours Services

Triple M Underground provides emergency drain and sewer services subject to crew and equipment availability.

Emergency, weekend, holiday, and after-hours service may carry additional dispatch, diagnostic, or mobilization charges.

For certain emergency calls, upfront electronic payment of a disclosed call-out fee may be required before dispatch.

The fee, its purpose, and the applicable cancellation terms will be explained before the customer authorizes dispatch. Any remaining amount owed for authorized services is generally due upon completion unless otherwise agreed.

A diagnostic or emergency visit does not guarantee that the underlying issue can be permanently resolved during the initial appointment.

Additional repairs or excavation may require a separate estimate and authorization.

Nothing in this section limits cancellation or refund rights provided by applicable law.

5. Deposits and Payment Terms

Payment terms vary depending on the nature of the work.

Routine service calls, drain cleaning, and inspections generally require payment upon completion unless another arrangement is agreed upon.

Excavation, utility installation, and larger repair projects may require a deposit before materials are ordered, equipment is reserved, or work is scheduled.

The applicable deposit, payment milestones, and final payment due date will be stated in the accepted estimate or contract.

Any applicable late-payment charges or collection terms must be disclosed in the customer agreement and comply with applicable law.

Municipal, commercial, and HOA projects may have separate payment terms established by contract or purchase order.

6. Cancellation and Rescheduling

Customers are encouraged to provide at least 24 hours' notice when canceling or rescheduling routine appointments whenever possible.

If a crew has already been dispatched or authorized project expenses have been incurred, reasonable charges may apply when previously disclosed and permitted by law.

Charges may relate to completed work, actual mobilization, or specially ordered nonreturnable materials, depending on the circumstances and applicable agreement.

We do not automatically charge the full project price simply because an appointment is canceled.

Minnesota consumer cancellation rights: Certain residential transactions may qualify for a statutory cancellation period, including a three-business-day right to cancel under Minnesota's Home Solicitation Sales Act. Applicable exceptions may apply.

When the law requires cancellation notices or forms, they must be provided separately in the required manner. These website terms do not replace those notices or waive statutory cancellation rights.

7. Property Access and Customer Responsibilities

Customers are responsible for providing reasonable and safe access to the work area.

Before service, customers should disclose known site hazards, existing underground improvements, irrigation systems, privately installed utilities, and other conditions that could affect the work.

Customers may be asked to move vehicles, outdoor items, or other obstructions and to secure pets away from active work areas.

Customers requesting work must own the property or have appropriate authorization from the owner or responsible party.

If access is unavailable or unsafe, work may be rescheduled or suspended. Any charges will be determined under the applicable agreement and law.

8. Utility Locates and Underground Conditions

Triple M Underground will comply with applicable Minnesota excavation safety laws, including required notifications to Gopher State One Call (811), marking of proposed excavation areas, and other duties applicable to the excavator.

Public utility locate requests do not necessarily identify privately owned facilities, including irrigation systems, invisible pet fences, landscape lighting, private electrical lines, and similar underground improvements.

Property owners and customers should disclose known private facilities and arrange for private locating when necessary. Responsibility for arranging and paying for additional private locating should be established before work begins.

Triple M Underground will use reasonable care around known or suspected underground utilities and will comply with applicable safe-excavation requirements.

The existence of unmarked utilities does not automatically relieve any party of responsibility for negligence or violation of applicable law.

If unexpected conditions create safety concerns, work may be stopped until the situation can be evaluated.

9. Permits, Inspections, and Utility Coordination

Some projects require municipal permits, inspections, utility shutdowns, access approvals, traffic control, or other governmental authorization.

The project proposal or agreement will identify which permits, inspections, fees, and related services are included.

Unless expressly included, additional permit fees, municipal charges, pavement restoration requirements, and other agency-imposed costs may be excluded from the quoted price.

Necessary permits and approvals must be obtained before performing work that legally requires them.

Permit processing and inspection schedules may affect the project's anticipated completion date.

10. Sewer and Drain Cleaning

Drain cleaning, cable services, and hydro jetting are intended to remove or reduce obstructions and improve drainage.

Existing pipes may contain hidden defects, corrosion, root intrusion, cracks, offset joints, or deteriorated sections.

Clearing a blockage does not repair underlying structural defects or guarantee that another blockage will not occur.

Cleaning may reveal previously concealed pipe problems. Triple M Underground will use reasonable professional judgment in selecting cleaning methods and equipment.

If further inspection, repair, or replacement is recommended, that work will be discussed and separately authorized.

Nothing in this section excludes responsibility for damage caused by failure to use reasonable care.

11. Sewer Camera Inspections

Sewer camera inspections document conditions visible in accessible sections of piping at the time of inspection.

Visibility may be limited by water, debris, obstructions, pipe configuration, or access restrictions.

An inspection does not guarantee identification of every concealed defect or predict a pipe's remaining service life.

Videos, photographs, inspection reports, and recommendations are based on observations reasonably obtainable during the inspection.

Any specific inspection deliverables will be identified when the service is authorized.

12. Excavation and Property Restoration

Excavation may disturb lawns, landscaping, driveways, sidewalks, fences, irrigation systems, and other improvements near the work area.

Triple M Underground will use reasonable care to limit unnecessary disturbance.

Restoration is limited to the work expressly included in the approved estimate or agreement.

Depending on the scope, restoration may include backfilling, compaction, rough grading, topsoil, seed, erosion-control materials, or temporary surface repairs.

Unless specifically included in writing, permanent asphalt or concrete restoration, sod, specialty landscaping, replacement plants, and repair of unrelated preexisting conditions may be excluded.

Temporary asphalt or other temporary repairs are not represented as permanent restoration.

Weather, soil settlement, watering, and maintenance may affect seeded or restored areas. Applicable restoration responsibilities and warranty terms will be identified in the project agreement.

13. Safety and Work Suspension

Triple M Underground may suspend or reschedule work when reasonably necessary to address unsafe conditions, unstable excavations, hazardous materials, unexpected utility conflicts, severe weather, lack of required authorization, or other substantial safety concerns.

We will communicate significant issues and discuss appropriate next steps.

The treatment of completed work, authorized expenses, deposits, and any project changes will be governed by the applicable agreement and law.

14. Warranties and Workmanship

Triple M Underground is committed to professional workmanship and dependable service.

Warranty coverage, duration, and applicable exclusions are determined by the written estimate, invoice, or project agreement and any applicable law.

Different types of work may have different warranty periods or coverage.

A warranty may distinguish between defects in work performed by Triple M Underground and unrelated problems, normal wear, improper maintenance, third-party damage, or new conditions arising after completion.

Customers should contact us within a reasonable time after discovering a suspected service
